In the processing of personal data, the Personal Data Protection Law No. 6698 ("KVKK"), which aims to protect individuals' fundamental rights and freedoms, particularly the right to privacy, and to regulate the obligations of real and legal persons processing personal data as well as the principles and procedures to be followed in data processing activities, was published and came into force on April 7, 2016.
This Privacy Notice has been prepared in accordance with Article 10 of KVKK titled "Data Controller's Obligation to Inform" to provide the most transparent information about the identity of the data controller, the method/legal basis of collecting your personal data, the purposes for which these data will be processed, to whom and for what purposes these data may be transferred, and your rights listed under Article 11 of KVKK. The explanations regarding your personal data also cover your sensitive personal data.
Our TİMS GRUP companies, namely ‘TİMS B STÜDYO FİLM VE ORGANİZASYON SAN. VE TİC. A.Ş. (Mersis No:.........................) and ‘TİMS PRODÜKSİYON FİLM ORGANİZASYON SAN. VE TİC. A.Ş. (Mersis No:.........................) are collectively referred to as 'TİMS GRUP' in this Privacy Notice.
Data Controller
Under KVKK No. 6698, the Data Controller is ‘TİMS GRUP’, and your personal data will be collected and processed within the scope described below.
Method and Legal Basis for Collecting Your Personal Data
Your personal data may vary depending on your relationship with our companies and may be collected verbally, in writing, or electronically through automatic or non-automatic methods via company headquarters, activity units (sets), websites, call centers, third-party service/product providers, and similar means. These data may be created and updated throughout your relationship with our company and stored both digitally and physically.
Purposes for Processing Your Personal Data
The collected personal data may be processed for the following purposes:
Management of Human Resources processes and policies of the companies, supporting recruitment processes for group companies
Fulfilling obligations arising from the Labor Law, Social Security Law, Occupational Health and Safety Law, and other relevant regulations
Managing employee assignment processes and tracking employee entry and exit, conducting processes related to employee benefits
Conducting internal audit/investigation/intelligence activities
Planning and executing emergency management processes
Carrying out necessary activities by relevant departments to ensure that commercial activities specified in the company's articles of association are performed in accordance with regulations and company policies
Planning and executing TİMS GRUP’s commercial and/or business strategies, conducting audit activities, and informing board members in this regard
Ensuring coordination and exchange of information/documents between TİMS GRUP companies and third-party legal entities
Establishing contractual relationships with copyright holders for the use of works within the scope of cinema and TV series projects, tracking contractual processes, fulfilling obligations under the Intellectual and Artistic Works Law No. 5846 and other relevant regulations, and informing authorized third-party individuals and legal entities about the transfer of financial rights
Evaluating the suitability of actors for projects in cinema and TV series projects and conducting promotional activities for clients
Signing distributor and sponsor agreements and tracking contractual processes
Increasing the recognition and awareness of cinema and TV productions through activities in visual, written, digital, and social media channels and ensuring coordination with service providers in this field
Establishing and managing relationships with customers/potential customers/suppliers (authorized representatives and employees), conducting communication activities, tracking contractual processes, ensuring financial reconciliation, and fulfilling legal, commercial, and administrative obligations arising from the contracts
Complying with audit obligations under labor and social security laws regarding supplier company employees assigned to sets
Managing financial and accounting transactions
Conducting and following up legal processes
Ensuring the safety of life and property and legal, commercial, and occupational health and safety of individuals and/or legal entities (employees, visitors, suppliers, customers, etc.) associated with our companies, as well as ensuring physical security and audit of locations under our company's usage
Managing and tracking requests/complaints
Planning, auditing, and executing information security processes
Keeping internal internet access logs in accordance with Law No. 5651
Fulfilling requests for information and documentation by judicial bodies and/or administrative authorities
Providing information to authorized institutions and organizations due to legal obligations and fulfilling activities and obligations related to inspections
Taking necessary technical, legal, and administrative measures within the scope of data security
These purposes are in compliance with the data processing conditions and purposes specified in Articles 5 and 6 of KVKK.
To Whom and For What Purpose Your Processed Personal Data May Be Transferred
In accordance with KVKK No. 6698 and related legal regulations, your processed personal data may be shared, limited to the purposes specified in the "Purposes for Processing Your Personal Data" section of this Privacy Notice, with third-party real or legal persons (suppliers)/subcontractors from whom our company receives goods/services under contract for conducting company services and activities, third-party legal entities with whom the company collaborates, third-party real or legal persons (customers)/subcontractors to whom our company provides products and services under contract, public institutions or organizations authorized to request such data due to legal obligations, third-party legal entities, TİMS GRUP companies and board members, within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of KVKK.
Personal Data Processing Procedure
Our company informs personal data owners about the methods of collecting personal data, purposes for processing data, data processing procedures, purposes and recipients of data transfers, and the rights of the data owner. In cases where explicit consent is required by law, the data owner's explicit consent is obtained after fulfilling our obligation to inform.
Data Retention Period
In data retention processes, personal data are processed and stored by considering the data processing purposes, data retention periods, legal obligations, and statute of limitations. When determining retention periods, priority is given to whether there is a period specified in the relevant legislation for retaining personal data. If a period is specified, it is adhered to; if not, personal data are retained for the duration necessary for the purpose for which they are processed, taking into account civil and criminal statute of limitations. When the retention period expires or the reasons requiring the processing of personal data no longer exist, personal data are deleted or destroyed. If the legislation regulates the data processing periods separately, the data may also be processed in compliance with these periods.
Rights of Personal Data Owners as per Article 11 of KVKK
Without prejudice to the provisions of Article 28 titled "Exceptions" of KVKK, you may apply to TİMS GRUP within the framework of Article 11 of the Law to:
a) Learn whether your personal data is processed or not,
b) Request information if it has been processed,
c) Learn the purpose of processing your data and whether it is used in line with that purpose,
d) Know the third parties to whom your personal data has been transferred domestically or abroad,
e) Request correction if your personal data has been processed incompletely or incorrectly,
f) Request the deletion or destruction of your personal data within the framework of the conditions specified in Article 7 of the Law,
g) Request notification of the processes carried out in accordance with paragraphs (e) and (f) to third parties to whom your personal data has been transferred,
h) Object to any adverse outcome to your detriment through the analysis of your data exclusively by automated systems,
i) Claim compensation for damages if you suffer damage due to unlawful processing of your personal data.
Applications can be made by completing the ‘Data Owner Application Form’ available on ‘www.timstv.com’ and submitting it in writing or electronically using the following methods.
For Written Applications:
The signed Data Owner Application Form can be delivered in person with a document verifying your identity, through an authorized representative with notarized power of attorney for applications within the scope of Article 11, or sent via notary or registered mail to the TİMS GRUP headquarters at: Levent mah. Levent cad. Lale sok. No:11 Levent/ISTANBUL.
For Electronic Applications:
The Data Owner Application Form, signed with a "secure electronic signature" certificate defined in the Electronic Signature Law No. 5070, can be sent to the registered electronic mail (KEP) address listed in the appendix or via email to info@tims.tv.
Requests submitted to TİMS GRUP will be answered in writing or electronically within the shortest time possible and no later than thirty days, depending on the nature of your request, and in accordance with the procedure and fee specified in Article 7 of the Communique on Procedures and Principles of Application to the Data Controller.
Changes
TİMS GRUP reserves the right to update this Privacy Notice in line with potential changes to KVKK No. 6698 or principles and procedures determined by the Personal Data Protection Board.
